This Privacy Policy applies to our use of any and all Data collected by us or provided by you.

 

Personal data is all information that relates to an individual who can be identified from the data.  We know how important it is to protect the privacy of all individuals and to comply with Data Protection laws.  We will safeguard your personal data and will only disclose it where it is lawful to do so or with your consent.

 

We only process personal data that is relevant for meeting our professional obligations.  The types of data collected may include your name, address, contact details, your personal circumstances, ethnicity, religious beliefs and details of any other persons, including children, who may have an involvement in your case.  The personal data will usually be obtained directly from you.  It may also be obtained from other sources such as professional or public organisations. 

 

When we ask you for personal data we will only ask for appropriate information and not collect information that is irrelevant or excessive.  We will protect it and make sure no unauthorised person has access to it.  We may share it with other organisations but only where necessary, permitted by the law or with your authorisation.    We will make sure that we do not keep it any longer than is necessary. 

 

You can request access to the personal data which we keep on you or ask for it to be corrected.  You can object to our processing of your personal data or ask for it to be restricted.  You also have the right to lodge a complaint with the Information Commissioner if you are unhappy with the way in which we hold or treat your personal data.

 

Use of Information

 

The information you provide us will only be shared with other parties where it is appropriate or necessary to do so.  There are strict rules about when information about certain cases may be disclosed especially in Court cases.  Where we are required to share personal data we will comply with all aspects of the rules, including Data Protection laws.

 

It may sometimes be necessary to transfer personal data oversees for the establishment exercise or defence of legal claims.  The reasons for the transfer and the recipient country will always depend on the circumstances of the case but any such transfers will be made in full compliance with all aspects of the law.

 

We will use technical and organisational measures to safeguard your data at all times.  We are certified to the Specialist Quality Mark Standard.

Your Rights

 

You have the following rights in relation to your data:

 

  1. The right to request (i) copies of the information we hold about you at any time or (ii) that we modify update or delete such information.

If  we provide you with access to the information we hold about you we will not charge you for this unless your request is manifestly unfounded or excessive.  Where we are legally permitted to do so we may refuse your request but if we do so we will tell you the reasons why.

 

  1. The right to have your data rectified if it is inaccurate or incomplete.
  2. The right to request that we delete or remove your data from our systems.
  3. The right to “block” us from using your data or limit the way in which we can use it.
  4. The right to request that we move copy or transfer your data.
  5. The right to object of our use of your data including where we use it for our legitimate interests.

If you are not satisfied with the way a complaint you make in relation to your data is handled by us, you may be able to refer your complaint to the relevant data protection authority.  For the UK this is the Information Commissioners Office.

 

Changes of Business Ownership and Control

 

Lillywhite Williams & Co may from time to time expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of Lillywhite Williams & Co.  Data provided by clients will, where it is relevant to any part of our business so transferred, be transferred along with that part and the new owner or newly controlling party will under the terms of this Privacy Policy be permitted to use the data for the purposes for which it was originally supplied to us.

 

We may also disclose data to a prospective purchaser of our business or any part of it, on a strictly confidential basis. 

 

In the above instances we will take steps with the aim of ensuring your privacy is protected.

 

General

 

You may not transfer any of your rights under this Privacy Policy to any other person.  We may transfer our rights under the Privacy Policy where we reasonably believe your rights will not be affected. 

 

If any Court or competent authority finds that any provision of this Privacy Policy (or part of any provision) is invalid illegal or unenforceable, that provision or part provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this Privacy Policy will not be affected.

 

Unless otherwise agreed, no delay act or omission by a party in exercising any right or remedy will be deemed a waiver of that or any other right or remedy.

 

Lillywhite Williams & Co reserves the right to change this Privacy Policy as we may deem necessary from time to time or as may be required by law.  You will be deemed to have accepted the terms of any changed Privacy Policy.

 

This Privacy Policy has been drawn up in order to comply with the General Data Protection Regulation (EU) 2016/679.
